Terms of Use
Welcome to Canceria. These Terms govern access to and use of the Canceria website, content, features, and related services (the “Services”).
By accessing or using the Services, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the Services.
1. Services and Medical Information
Canceria publishes cancer-related educational information, research summaries, and other resources. It provides a Cancer Case Review process and may provide member resources or other services. Service scope and availability may change and may be subject to service-specific terms.
General website content is not a diagnosis, prescription, treatment plan, or substitute for professional medical care. A Cancer Case Review may consider information about an individual case and may include individualized treatment-related research or analysis within the scope of the service then offered. It does not by itself create a physician–patient or other healthcare-provider relationship and does not guarantee a diagnosis, recommendation, clinical treatment, acceptance, completion, response time, further service, or health outcome.
Do not start, stop, delay, or change treatment based only on website content or a Canceria review. Consult the healthcare professional responsible for your care. See the Disclaimer for additional information.
2. Eligibility and Authority
You may use the Services only if you may lawfully do so under applicable law. If you submit information for another person or act for an organization, you represent that you have the authority required to do so. Age and guardian requirements are subject to applicable law and the Privacy Policy.
3. Canceria’s Discretion
Canceria may decide whether to accept, review, continue, limit, suspend, or decline a submission or service request. Canceria may modify, suspend, discontinue, or restrict any part of the Services, subject to applicable law and obligations already accepted for a service. No submission creates an obligation to accept a case, provide a response, continue a review, or offer a future service.
4. Accounts and Security
Some Services may require an account or access credentials. You are responsible for keeping credentials under your control and for promptly notifying Canceria if you believe an account has been used without authorization. Canceria may suspend or terminate access where it reasonably considers this necessary to protect the Services, users, or its rights, or to address a violation of these Terms or applicable law. Any action remains subject to applicable law and service obligations already accepted.
5. Permitted Use and Restrictions
Canceria grants you a limited, revocable, non-exclusive, non-transferable permission to access and use publicly available Services for personal, non-commercial purposes, subject to these Terms and applicable law. Access to restricted member or proprietary resources is limited to the access Canceria authorizes for the relevant account or service. No other right or license is granted by implication.
Except to the extent applicable law permits, you must not:
- Use the Services unlawfully or to violate another person’s rights.
- Attempt unauthorized access to an account, system, database, or non-public area, or bypass a security or access control.
- Interfere with, disrupt, damage, or place an unreasonable load on the Services.
- Introduce malicious code or use the Services to distribute harmful material.
- Scrape, crawl, harvest, or systematically extract content or data by automated means without Canceria’s prior written permission.
- Reproduce, republish, distribute, sell, license, or commercially exploit Canceria materials without permission, except where these Terms or applicable law allow it.
- Misrepresent your identity or authority, or use the Services to mislead, harass, or harm Canceria, users, or others.
- Share credentials or provide unauthorized access to restricted resources.
Nothing in these Terms restricts an exception or limitation that applicable law makes non-waivable.
6. Intellectual Property and Restricted Materials
Canceria’s Services may include research, analyses, frameworks, methods, datasets, databases, compilations, text, articles, graphics, logos, designs, photographs, videos, software, and other materials, including unpublished, member-only, confidential, or otherwise restricted materials. Rights in those materials belong to Canceria, its contributors, licensors, or other rightsholders, as applicable. Nothing in these Terms transfers ownership or grants rights beyond the limited access permission expressly stated here. All rights not expressly granted are reserved by the relevant rightsholder.
You may view and use publicly available material for the limited personal, non-commercial purpose described above. You may not copy, adapt, publish, distribute, publicly display, sell, license, create derivative works from, disclose restricted material, or otherwise commercially exploit any material without prior written permission, except to the extent applicable law permits. Third-party material remains subject to its owner’s rights and terms.
7. Information You Submit for a Private Service
You are responsible for information and files you submit and represent that you have the right and authority to provide them. Do not submit another person’s personal or health information unless legally authorized to do so. Do not submit unlawful material or material that infringes another person’s rights.
To the extent needed to receive, store, reproduce, review, communicate, secure, and provide the service you request, you grant Canceria permission to process the submitted material and make it available to providers involved in that service. This permission does not grant a general right to publish, display, adapt, or promote private case information, medical records, or confidential information. Any separate public use of case material requires the permissions and authorizations applicable to that use.
A submission does not guarantee that Canceria will review or respond to it or provide a service. Handling of personal information is described in the Privacy Policy and any service-specific notice. Submission does not create a professional relationship, legal privilege, or obligation to retain material for a particular period, except as applicable law or separate written terms require.
8. Cancer Case Review and Other Services
Cancer Case Review is an assessment and research process, not emergency care or a substitute for a treating clinician. Any additional individualized treatment-related support, membership, consultation, or other service is provided only if Canceria offers it and its scope and terms are agreed for that service. Additional terms, notices, eligibility rules, or fees may apply and govern the relevant service to the extent stated, subject to applicable law.
Canceria may decline a case or discontinue further consideration. No service guarantees a medical, financial, professional, or other outcome.
9. Fees and Payments
If a Service is paid, its price, scope, payment method, duration, and applicable cancellation or refund terms will be presented before purchase. Any service-specific terms presented before purchase form part of the agreement for that Service to the extent stated and permitted by law. Payment or membership does not guarantee a health or other outcome.
Canceria may change prices or introduce fees for future purchases. A change will not alter a completed purchase except as permitted by applicable law or agreed for that purchase.
10. Public Contributions
If a feature invites you to submit comments, feedback, reviews, or other material for possible public display or publication, you remain responsible for that material and must have the rights needed to submit it. Do not submit private medical records, Cancer Case Review information, or other confidential information through a public-contribution feature.
You grant Canceria a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, edit, translate, publish, display, and distribute material you intentionally submit for public display or publication, in connection with operating, presenting, promoting, and distributing Canceria’s Services. This license does not apply to private Cancer Case Review submissions, medical records, or other confidential information. It does not transfer ownership of your contribution. Canceria may decline, remove, or restrict a contribution at its discretion, subject to applicable law.
11. Third-Party Sources and Services
Canceria may refer to studies, organizations, researchers, products, services, and external websites. References are provided for information and further research and do not necessarily constitute endorsement or verification. Third-party services are governed by their own terms and privacy notices. Canceria does not control third-party services and, to the maximum extent permitted by law, disclaims responsibility for their content, availability, security, or privacy practices.
12. No Guarantees; Availability
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis without warranties, express or implied, including that the Services will be uninterrupted, secure, error-free, complete, current, or suitable for a particular purpose. Canceria does not warrant that information or research will be accurate, that an approach will be effective, or that a Service will meet your expectations.
Nothing in these Terms excludes a warranty or right that applicable law does not allow to be excluded.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Canceria and persons who operate, contribute to, or provide services for Canceria will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunity, arising out of or connected with use of or inability to use the Services. This exclusion applies whether the claim is based in contract, tort, statute, or another legal theory, to the extent permitted by law.
Separately, to the maximum extent permitted by applicable law, aggregate liability arising out of or connected with a paid Service will not exceed the amount paid directly to Canceria for the specific Service giving rise to the claim during the twelve months before the event. For a Service provided without charge, liability is excluded to the maximum extent permitted by applicable law. The cap does not apply to liability that applicable law prohibits limiting or excluding.
Nothing in these Terms excludes or limits a right, remedy, or liability that applicable law makes non-waivable. These provisions do not create an entitlement to reimbursement, compensation, or damages where none would otherwise exist. A separate service agreement may state additional limits to the extent permitted by law.
14. Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Canceria and persons who operate, contribute to, or provide services for Canceria from and against third-party claims, actions, demands, proceedings, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable legal fees, to the extent arising out of or relating to: (a) your use or misuse of the Services; (b) your violation of these Terms or applicable law; (c) your violation or infringement of another person’s rights, including intellectual property or privacy rights; or (d) information or material you submit through the Services, including any allegation that it is unlawful or infringes another person’s rights. Canceria will give you reasonably prompt notice of a claim for which it seeks indemnification, provided that delay relieves you of your obligations only to the extent you are materially prejudiced by the delay. Canceria may participate in the defense with counsel of its choice at its own expense. You may not settle a claim in a way that imposes an admission, payment, obligation, or restriction on Canceria or another indemnified person without that person’s prior written consent. This indemnity does not apply to the extent a claim is caused by the negligence, wrongful conduct, or breach of these Terms by an indemnified person, where applicable law does not permit you to indemnify that person for that claim, and it does not exclude or limit any non-waivable right or liability under applicable law.
15. Suspension and Termination
You may stop using the Services at any time. Canceria may suspend or terminate access, remove a contribution, or discontinue a Service as described in these Terms, subject to applicable law and service-specific obligations already accepted. Provisions that by their nature should continue—including intellectual property, permissions for submitted material, disclaimers, limitations of liability, indemnity, and dispute-related terms if applicable—continue to apply after access ends.
16. Privacy
The Privacy Policy describes information that may be processed in connection with the Services. It applies to that processing alongside any service-specific privacy or consent notice, subject to applicable law and mandatory privacy rights.
17. Changes to These Terms
Canceria may revise these Terms as the Services or applicable requirements change. The current version and its update date will appear on this page. Where applicable law requires advance notice, affirmative acceptance, or another step for a change, that requirement applies. Continued use constitutes acceptance only to the extent applicable law permits that method.
18. General
If a provision is found unenforceable, it will be limited or interpreted to the minimum extent permitted by law, and the remaining provisions will continue to apply to the extent permitted. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms and service-specific terms expressly incorporated into them describe the agreement concerning use of the Services, except where a separate written agreement applies. A service-specific term controls only for the service it addresses and to the extent stated, subject to applicable law.
19. Mandatory Rights
These Terms operate subject to mandatory laws that apply to you and the Services. Nothing here is intended to deprive you of a protection or remedy that applicable law does not permit you to waive.
20. Contact
